Conducting mediation usually involves three basic elements:

  • A neutral, licensed mediator
  • Two conference rooms
  • One attorney for each party

Each party sits in a separate conference room, and the mediator goes back and forth between them, working on revisions to the divorce settlement until both parties come to an agreement.

While neither party technically needs an attorney for the mediation process to go forward, it is highly advisable that you have one, especially if your settlement involves child custody issues or the division of significant assets. Remember, the mediator isn't there to advise you: he or she is only there to help you reach an agreement.
